General Terms and Conditions
 

§ 1 Scope and Contractual Partner

These General Terms and Conditions apply to all contracts concerning services, treatments, the sale of beauty products, vouchers (“Gift Cards”), the purchase of admission tickets, such as day passes, as well as membership contracts of ALMAS SPA & Beauty.

The contractual partner is ALMAS SPA, owner: Rabia Rasooly, Walther-von-Cronberg-Platz 3, 60594 Frankfurt am Main, Germany, email: info@almasspa.de, hereinafter referred to as the “Operator” or the “Spa”.

Any terms and conditions of the customer that conflict with or deviate from these General Terms and Conditions shall not be recognized unless the Operator expressly agrees to their validity.
 

§ 2 Conclusion of Contract

The presentation of services on the website does not constitute a legally binding offer. A booking made by the guest, whether online, by telephone, by email or on site, shall be considered a binding contractual offer.

The contract is concluded upon confirmation by the Spa, for example by email booking confirmation, or upon commencement of the service.
 

§ 3 Admission Tickets

Day Spa, Women’s Spa, Weekend & Holiday Spa

The purchase of admission tickets, such as Day Spa or Women’s Spa on Thursdays, for a specific date is binding.

As these are leisure services provided on a specific date, there is no statutory right of withdrawal for date-specific tickets pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB).

A rebooking or cancellation of date-specific tickets is only possible up to 24 hours before the booked date. After this period, the ticket expires without replacement.


§ 4 Appointment Bookings for Treatments, Massages and ALMAS Beauty

Booked treatments are reserved exclusively for the guest.

Cancellations: A free cancellation or rescheduling is possible up to 24 hours before the start of the appointment.

Cancellation fee / no-show: In the event of cancellations made less than 24 hours before the appointment or in the event of non-attendance, the full price of the booked service, 100%, will be charged or any deposit already paid will be retained, as the appointment can no longer be allocated to another guest. The guest retains the right to prove that a lower loss or no loss at all has occurred.

Late arrival: If the guest arrives late, the treatment time will be shortened accordingly in order not to disrupt subsequent appointments. The full treatment price remains payable.


§ 5 Memberships

Basic Plan, Premium Plan and Other Memberships

Contract term: The initial term of a membership is agreed individually upon conclusion of the contract.

Automatic renewal and cancellation: After the initial term has expired, the contract is automatically extended for an indefinite period. From this point onwards, it may be terminated by either party with one month’s notice. Cancellations must be made in text form, for example by email to info@almasspa.de.

Payment default: If the guest is in default with the payment of the monthly membership fee, the Spa reserves the right to refuse access to the facilities until all outstanding amounts have been settled.

Transferability: Membership benefits, including unlimited access or discounts, are personal and non-transferable. Any included guest passes may be used in accordance with the respective membership plan description.


§ 6 Gift Cards and Beauty Products

Gift Cards: Value vouchers are subject to the statutory limitation period and are valid for 3 years, calculated from the end of the year in which the voucher was issued. Cash payment, including payment of remaining balances, is excluded.

Product returns: Skincare and beauty products purchased at ALMAS Beauty may be exchanged within 14 days of purchase upon presentation of the receipt.

Exclusion for hygiene reasons: Sealed goods that are not suitable for return for reasons of health protection or hygiene, such as cosmetics, creams and similar products, are excluded from return and withdrawal if the seal has been removed after delivery, pursuant to Section 312g (2) No. 3 of the German Civil Code (BGB).


§ 7 Prices and Payment Terms

The prices displayed at the time of booking apply. All prices are stated in euros and include statutory VAT.

Payments for online purchases or memberships are due immediately or monthly in advance.

On site, the Spa accepts cash payments as well as common debit and credit cards.


§ 8 Health, Liability and Spa Etiquette

Health condition: The guest is obliged to inform the staff before the start of the treatment about any health risks, such as allergies, high blood pressure, pregnancy or recent surgeries. The Operator reserves the right to refuse treatments in the event of medical concerns.

Liability: The Spa is liable for damages resulting from injury to life, body or health caused by negligent or intentional breach of duty by the Spa. For other damages, the Spa shall only be liable in cases of gross negligence or intent.

No liability is accepted for the loss of clothing, valuables or money brought by the guest, unless caused by intent or gross negligence. The use of wet areas and sauna areas is at the guest’s own risk.

House rules and etiquette: ALMAS SPA is a place of absolute peace and relaxation. The use of mobile phones for photo, video or audio recordings is prohibited out of respect for the privacy of other guests. In the event of serious violations of spa etiquette, the Operator may issue a ban from the premises without any entitlement to a refund.


§ 9 Right of Withdrawal for Consumers

Online Purchases

Consumers have a statutory right of withdrawal for contracts concluded online, also known as distance contracts.

Withdrawal policy: You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date of conclusion of the contract for services or memberships, or from the day on which you have taken possession of the goods, products or vouchers.

To exercise your right of withdrawal, you must inform us, ALMAS SPA, Walther-von-Cronberg-Platz 3, 60594 Frankfurt am Main, Germany, email: info@almasspa.de, by means of a clear statement of your decision to withdraw from the contract.

Exception: The right of withdrawal expires prematurely for services if we have fully performed the service with your express consent.

Pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB), the right of withdrawal does not apply to date-specific admission tickets, such as day passes or events.


§ 10 Dispute Resolution

The European Commission provides a platform for online dispute resolution, which can be found at: https://ec.europa.eu/odr

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


§ 11 Final Provisions

The law of the Federal Republic of Germany applies.

If you are a merchant or a legal entity under public law, the place of jurisdiction for all disputes shall be the registered location of ALMAS SPA, Frankfurt am Main.

Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining contract shall remain unaffected.
